Comments: As of January 5, 2020, the FMCSA launched the FMCSA Clearinghouse website. All DOT SAP Return to Duty process now go through it to verify completion of the process. All employers must submit queries for prospective employees who fall under the FMCSA DOT regulations. If you're a driver who has a FMCSA violation AFTER January 5, 2020, you can register in the Clearinghouse at: https://clearinghouse.fmcsa.dot.gov/Register. There is also a Clearinghouse FAQ page at: https://clearinghouse.fmcsa.dot.gov/FAQ.

Comments: Hey Ralph quick question: The follow up plan for our employee gave the number of tests to be preformed and frequency. Do we schedule them or are you going to give us a schedule for them? Thanks in advance!
Admin reply: Hi Debbie! No, the regulations instruct the SAP to not specify dates for the tests and that the employer schedules the random Follow Up Testing Plan required tests. In DOT Rule 49 CFR Part 40 Section 40.307 (d)(3) "You are not to establish the actual dates for the follow-up tests you prescribe. The decision on specific dates to test is the employer's." Let me know if you have any other questions!

Comments: Hey Ralph, how long am I going to be doing these follow up tests?
Admin reply: Hi James, sorry but the regulations prohibit an SAP or employer from disclosing the duration and frequency of the Follow Up Testing Plan. "40.329 (c) As a SAP, you must make available to an employee, on request, a copy of all SAP reports (see ยง 40.311). However, you must redact follow-up testing information from the report before providing it to the employee." Let me know if you have any other questions.

Comments: Got my certs straight man. Thanks! Thanks for explaining how I could work with my coast guard officer to meet their loads of requirements. When I got their packet in the mail and met with the officer I was overwhelmed. I had no idea where to go to get the screens done but I found a MRO with a drug testing company. They called me every month to go test. Clean as a whistle now!
Admin reply: That's awesome Neal! Congratulations! Yeah the coast guard requires so many additional steps to the normal process. I guess I would say that it's a return to duty process x 10 but then again as you know it's all about public safety and they are a branch of the military that certifies navigators. Congrats!
